These Terms of Service (“Terms”) govern your access to and use of applications, websites, and services (the “Service”) provided by Black Ram Labs Pty. Ltd. (“we,” “our,” or “us”).

By creating an account, downloading, or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 16 years old (or the minimum legal age in your country) to use the Service. If you are under 16, you may only use the Service through a parent or legal guardian.

2. Account Registration

You agree to:

• Provide accurate, complete, and current information (including height, weight, date of birth, equipment details).

• Keep your login credentials secure.

• Notify us immediately of unauthorised use of your account.
  You are responsible for all activity that occurs under your account.

3. Data We Collect

The Service may collect and process:

• Personal Information: Name, email, billing or purchase details, contact information.

• Profile Data: Height, weight, date of birth, gender, fitness preferences.

• Activity & Sensor Data: GPS location, route, speed, distance, elevation, cadence, heart rate, power, and other biometric/equipment sensor readings.

• Equipment Data: Bikes, components, and related settings.

• User-Provided Data: Free-form notes, comments, and other input you choose to enter.

• Social Data: Messages, posts, and other interactions with users.

• Device & Usage Data: Device identifiers, operating system, IP address, app version, and feature usage.

4. Use of the Service

You agree not to:

• Provide false or misleading information.

• Interfere with security, functionality, or data integrity of the Service.

• Share content that is unlawful, offensive, or infringes rights.

5. Social Features

You may connect with other users and share activity data. Privacy settings control what information is visible. You are solely responsible for content you share.

6. Data Storage & Sharing

• Data is stored securely on cloud servers, possibly outside your country.

• We may share anonymised or aggregated data with third parties to help them improve their products, services, or facilities.

• If you connect the Service to another platform (e.g., social media, fitness apps, third-party devices), we may share your data with that service based on your authorisation. You may revoke such access at any time.

• We may retain anonymised data for analytics and industry research, even after account deletion.

7. Purpose of Data Use

• Plot activity profiles and calculate accurate metrics.

• Provide advanced analytics and performance feedback.

• Measure equipment usage to improve current and future products.

8. Health & Safety Disclaimer

The Service is not a medical device. Training advice and performance feedback are informational only and not medical advice. Consult a healthcare professional before starting new exercise programs. You accept full responsibility for risks related to physical activity.

9. Intellectual Property

All content, trademarks, and software of the Service are owned by or licensed to us. You are granted a limited, non-exclusive license for personal, non-commercial use only.

10. Termination

We may suspend or terminate your account if you violate these Terms or if we discontinue the Service. Upon termination:

• Access to your account ends.

• Personal data is deleted per our Privacy Policy.

• Anonymised data may be retained.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

• Injuries, damages, or losses from physical activities.

• Data loss or corruption.

• Unauthorised access to your account.

12. Changes to Terms

We may update these Terms. Material changes will be communicated via the Service or email. Continued use means acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Western Australia.
